§ 1 Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für die Nutzung aller mobilen Anwendungen (Apps), die von ClearSuite Apps ([DEIN NAME]) entwickelt und über den Apple App Store vertrieben werden.

Mit dem Herunterladen und der Nutzung unserer Apps erklären Sie sich mit diesen AGB einverstanden.

§ 2 Leistungsbeschreibung

ClearSuite Apps stellt iOS-Anwendungen bereit, die lokal auf Ihrem Gerät funktionieren. Der genaue Funktionsumfang ergibt sich aus der jeweiligen App-Beschreibung im Apple App Store. Wir behalten uns vor, den Funktionsumfang jederzeit zu erweitern, einzuschränken oder einzustellen.

§ 3 Preise und In-App-Käufe

Unsere Apps können kostenlos oder kostenpflichtig angeboten werden. Sofern In-App-Käufe verfügbar sind, werden die jeweiligen Preise im Apple App Store angezeigt. Der Kaufvertrag kommt zwischen Ihnen und Apple Inc. zustande. Es gelten die Nutzungsbedingungen von Apple.

§ 4 Nutzungsrechte

Mit dem Erwerb einer App erhalten Sie ein einfaches, nicht übertragbares Recht zur Nutzung der App auf Ihren persönlichen Geräten. Die Vervielfältigung, Weitergabe, Bearbeitung oder Dekompilierung der App ist nicht gestattet, sofern nicht gesetzlich ausdrücklich erlaubt.

§ 5 Haftung

Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten), und dies beschränkt auf den vorhersehbaren, vertragstypischen Schaden.

Für Datenverluste haftet ClearSuite Apps nur bis zur Höhe des Aufwands, der bei regelmäßiger und gefahrentsprechender Datensicherung angefallen wäre.

§ 6 Verfügbarkeit

Wir bemühen uns um eine möglichst unterbrechungsfreie Nutzbarkeit unserer Apps. Ein Anspruch auf ununterbrochene Verfügbarkeit besteht nicht. Wartungsarbeiten, Updates oder Faktoren außerhalb unseres Einflussbereichs können zu vorübergehenden Einschränkungen führen.

§ 7 Änderungen der AGB

Wir behalten uns vor, diese AGB jederzeit zu ändern. Die geänderten Bedingungen werden über die Website oder im Rahmen von App-Updates bekannt gegeben. Mit der weiteren Nutzung der App nach Bekanntgabe der Änderungen stimmen Sie den aktualisierten AGB zu.

§ 8 Anwendbares Recht

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Gerichtsstand ist, soweit gesetzlich zulässig, der Wohnsitz des Anbieters.

§ 9 Schlussbestimmungen

Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§ 2 Service Description

ClearSuite Apps provides iOS applications that function locally on your device. The exact scope of features is described in the respective app listing on the Apple App Store. We reserve the right to expand, limit, or discontinue features at any time.

§ 3 Prices and In-App Purchases

Our apps may be offered free of charge or for a fee. If in-app purchases are available, the respective prices are displayed in the Apple App Store. The purchase agreement is concluded between you and Apple Inc. Apple's terms of use apply.

§ 4 Usage Rights

By purchasing an app, you receive a simple, non-transferable right to use the app on your personal devices. Reproduction, distribution, modification, or decompilation of the app is not permitted unless expressly allowed by law.

§ 5 Liability

We are fully liable for intent and gross negligence. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable, typical contractual damage.

ClearSuite Apps is only liable for data loss up to the amount of effort that would have been incurred with regular and appropriate data backup.

§ 6 Availability

We strive to ensure uninterrupted usability of our apps. However, there is no entitlement to uninterrupted availability. Maintenance work, updates, or factors beyond our control may lead to temporary restrictions.

§ 7 Changes to Terms

We reserve the right to modify these Terms of Service at any time. The updated terms will be communicated via the website or through app updates. By continuing to use the app after the announcement of changes, you agree to the updated terms.

§ 8 Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, to the extent legally permissible, the domicile of the provider.

§ 9 Final Provisions

Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected.
